Developement of the potential of the human resource of the judiciary by establishing an effective model for acquiring licensed capacity to practise law

With the amendments to the Judiciary System Act (JSA) of 2016 previously acting rules for internship programs (IPs) and exam after graduation in "Law" are approved. Six month IP is divided into two stages - major for 2 months, and professional - for 4 months, which may take place in the judiciary, lawyer, notary, bailiff and others acc. to Art. 297, p. 2 pt. 2 of the JSA. In this connection it is necessary to examine and exchange best practices with EU member states in conduction of IPs and exams after graduation in "Law". For the application of the new rules at least 2 models of IPs will be drafted - 1 for the major stage and 1 for the professional stage in Judiciary. The model of the IP for the professional stage in the Judiciary will settle in detail the specific actions that must be performed by trainees in the judiciary, according to their specificities, their duties, roles and responsibilities of mentors and others. Capacity of mentors will be also improved through training. The exam for acquiring legal capacity (EALC) has not been changed in the last 15 years, as with the latest amendments to the JSA is envisaged to take place in the form of case study and practical test. It is necessary the exam to match the experience gained during the major stage of IP and case study - to the experience gained during the professional stage of the internship. Because of this case study for the EALC should be different according to where held professional stage internship - in the judiciary, a lawyer, notary, bailiff etc. In this regard, should be drafted in detail the elements for the exam - criteria for selecting the case study, algorithm, methodology for assessing etc. This will ensure a serious selection of candidates through adequate check of their skills for application of knowledge.
