Effective access to justice

Independence, efficiency and transparency of the judiciary are among the most serious problems identified by the community. In this respect are the recommendations of the European Commission, whose research with benchmark "effectiveness of the judicial system" Bulgaria traditionally ranks last among Member States. Efficiency is part of the evaluation of the quality of a system, as citizens are particularly sensitive in terms of access to justice, which can be measured by various indicators, including the application of procedural rules in the proceedings.The Updated Strategy for Continuing Reform of the Judicial System adopted by the National Assembly in January 2015 provides for periodic surveys on satisfaction of the citizens of the judiciary, as well as on its independence. According to Art. 30 JSA Supreme Judicial Council is obligated to prepare annual reports on the independence and transparency of the judicial authorities. In the framework of the the project methodologies for public opinion polling on satisfaction from the judicial system and on its independence will be developped. Pilot studies on the developed methodologies will be conducted. They will be analyzed possibilities for access to justice in different criteria and model of access to justice in one district court area will be established, which will serve as a standard for application in the others, so that all citizens in the country to be ensured equal access to justice. Methodology for assessing the effect of the application of APC, CPC and PPC will be prepared too, so that an reasoned decision about their amendments be formed. The methodology will be implemented by working groups with representatives of the beneficiary and magistrates in subsequent periodic analyzes on the effect of the procedural codes. Representatives of the beneficiary and the project partner will be trained on the application of the drafted methodologies under activities 2 and 4 of the project.
