Development of arbitration as an alternative method of legal disputes resolution

The project is based on the concept of the Updated Strategy to Continue the Reform of the Judicial System 2020, according to which the development of alternative forms of dispute resolution is an effective way to reduce the excessive workload of the courts and contribute to the better administration of the judiciary. In order to achieve this strategic goal, it is necessary to create conditions for qualitative arbitration by qualified arbitrators, as well as a good knowledge of the merits of the arbitration by the stakeholders. Based on this necessity, the project envisaged logically related and complementing activities aimed at enhancing the quality of arbitration and its popularization among the target groups. A research and analysis of the case law on annulment and nullity of arbitration decisions will be conducted. An analysis of the compliance of the International Commercial Arbitration Act with recognized world models and the preparation of a concept for legislative changes is envisaged. The aim is to identify common gaps in arbitration and to create conditions for adopting good practices. The analyzes will be edited in electronic editions and will be presented at a conference where the standards of the arbitrators' work will be discussed. Training of trainers and training of arbitrators for the development of specific skills are foreseen. An information campaign to promote arbitration will be held in the form of information meeting.The project has a duration of 18 months and will be implemented by both Beneficiary and Partner staff and external experts. The project proposal builds on the results achieved by OPAC, 2007-2013. The proposal complements the "Strategic projects in implementation of the Updated Strategy for Continuing Judicial Reform .." but does not include activities foreseen for financing under Measure 3.2. 4. of the Roadmap to the Updated Strategy, where only funding for mediation is considered.
