Legal Balancer - Online Access to Justice

“Legal Balancer - Online Access to Justice” is a project, within which an independent analysis of the judiciary reform in the area of out-of-court dispute resolution will be carried out, best practices for increasing the role of alternative dispute resolution methods will be proposed and a unique online mechanism will be created, which will allow the consumer, for free and remotely, to “measure” their chances for resolving a certain legal case. The aim of the project proposal is, through analysing the results from utilisation of out-of-court instruments for dispute resolution in the country and researching corresponding best practices for promotion of the development of alternative dispute resolution, to contribute to resolving one of the structural issues within the judicial system, namely that it is overloaded. The concrete measures which will be adopted in achieving this are: 1) analysis of the number of court proceedings, finalised with an agreement; 2) identification of the preconditions that have made the agreement reached possible and of the circumstances which support reaching an out-of-court settlement; 3) systematization of good practices with successful examples of alternative dispute resolution and delineation of the measures through which the latter can be integrated within the judiciary as a part of the judicial reform; 4) development of an online portal with access to information regarding the methods of alternative dispute resolution, which will provide citizens with the opportunity to make more informed decisions while taking care of their legal protection. The aim of this is the promotion of the benefits of out-of-court dispute resolution. Thus, the project proposal will combine analysis of possible resolutions whilst promoting out-of-court resolution methods and will create a possibility for resolution with the potential to give citizens and legal persons the power to access justice with an alternative to court proceedings.
