Improvement of the procedures and rules for work of the administration in the courts through development of a general framework with standardized uniform rules for work in main aspects of the activity of the court administration

Divergent rules and procedures for work of the administration in the different courts have been identified in main aspects, important for the work of the courts and the public confidence in the institutions of the judiciary. For example: human resources management, management of the administration in the conditions of a state of emergency, incl. allocation of the obligations during teleworking, administrative service for citizens and business, financial management and control, asset management and protection, privacy policies, processing of and access to cases, personal data protection, anti-corruption procedures and rules, communication with representatives of the media, incl. on cases of high public interest, etc. This leads to ambiguities and contradictions and it is a prerequisite for making mistakes. These shortcomings to a significant extent hinder the work of the court clerks and have an unwanted public response in the field of judicial and administrative services. The lack of general framework of rules for the activity of the administration leads to contradictory administrative practices, which creates unpredictability in its work. The project proposal aims to overcome this problem through the development of standardized rules for the administration in the courts, based on the best and working practices, so that the efficiency of the judiciary improves, there is an increase of the quality of the activity of the court administration and the public confidence is strengthened. The development of these rules will be based on a survey and field observation of the opinion of the public and the court clerks about the administration’s way of operating and on a thorough analysis of the rules and procedures in force in the different courts. The developed general framework will be presented and discussed with interested parties at a round table and, if the results show a necessity, it will be amended and/ or additions will be made
