Ensuring real public participation in the administration of justice through the Institute of Juries

Currently, the framework of the Institute of Juries and their rights and obligations is established in the Law on the Judiciary, the Criminal Procedure Code and in Ordinance 7 for the Jury, approved by the Plenum of the Supreme Judicial Council. The improvement of the institute of juries is set out in Specific Objective 2 in the Updated Strategy for the Continuation of the Reform of the Judiciary and in the Roadmap for Its Implementation. The project aims to improve the institute of juries by assessing the current legal framework and assessing the practice of at least 4 EU Member States with regard to jurors, on the basis of which, even after public discussions, proposals will be drawn up to make changes to the Law on the Judiciary and to Ordinance 7 on juries aimed at: 1) Ensuring real public participation in the administration of justice through the SPA Institute 2) Updating the Ethical Principles and Rules of Conduct of Jurors (SECTION VI. of Ordinance 7 for Jurors) 3) Introduction of a unified Declaration on the existence/absence of a conflict of interest of the jury The ethical rules for the conduct of the jurors comply with the current legal framework and the amendment envisaged under its draft will make it necessary to update them in order to bring them into line with the amended legal framework. An Electronic Juries Register (ERZ) will be developed and implemented, which will achieve the systematicization of the information for each juror and provide the opportunity to: (1) Publicity and accessibility of the register for citizens and society and (2) Follow the profile of each juror.
