Support for Vulnerable Persons among Third-Country Nationals in Return Proceedings

The project "Support for Vulnerable Persons among Third-Country Nationals in Return Proceedings by Applying the Case Management Method and Alternatives to Detention" provides holistic support within 24 moths to up to 80 foreign nationals on the territory of Bulgaria which fall within the category of "vulnerable persons" under Art. 3, pt. 9 of Directive 2008/115/EC (the Return Directive), and who are, at the same time, in proceedings for return a country of origin or transit, of a safe third country, but their return is postponed under under Art. 9 and Art. 14, para. 1 of Directive 2008/115/EC. Through the specialized, balanced and humane approach towards vulnerable persons, it is guaranteed, on one hand, that their human rights are respected, in accordance with the requirement of the Directive and of European and international law more generally, and, on the other hand, that they are supported in their ability to make informed decisions regarding their future and to comply with the measures imposed on them and their immigration procedures, until the successful resolution of their case - incl. through voluntary or forced return. The project builds on the experience of the beneficiary Center for Legal Aid - Voice in Bulgaria, which, between 2017 and 2021 has completed successfully two successive pilot projects for implementing alternatives to immigration detention though the case management method and stabilizing in the community of migrants in return proceedings until the time of the resolution of their case, and the experience of the partner organization "Mission Wings" in providing social and psychological services to refugees and migrants and other vulnerable persons, including mothers at risk, who are foreign nationals, through the delegated service "Mother and Baby Unit".
